• Enabling receipt of blessings and spiritual messages
• Providing information about religious events and ceremonies
• Creating a community for spiritual engagement
• Managing and tracking spiritual contributions

2. Acceptance of Terms

By accessing, downloading, installing, or using our Services, you:

1. Affirm that you are at least 18 years of age, or if you are between 13-17 years old, that you have obtained parental or guardian consent to use our Services
2. Agree to be bound by these Terms and our Privacy Policy
3. Agree to comply with all applicable laws and regulations
4. Acknowledge that these Terms constitute a legally binding agreement between you and Nercha

7. Offerings & Donations

7.1 Payment Processing

Nercha facilitates offerings and donations to religious institutions through third-party payment processors. By making an offering or donation:

1. You authorize us to charge your chosen payment method
2. You agree to provide accurate payment information
3. You acknowledge that offerings/donations are generally non-refundable
4. You understand that we may deduct transaction fees as disclosed at the time of payment

7.2 Religious Institutions

We partner with religious institutions to facilitate offerings and donations. However:

• We do not endorse any specific religious institution
• We are not responsible for the use of donations by religious institutions
• We do not guarantee the tax deductibility of donations (consult a tax professional)
• We are not liable for any disputes between users and religious institutions

7.3 Receipts and Records

We provide digital receipts for all transactions. It is your responsibility to maintain records for tax or personal purposes. Religious institutions may provide additional acknowledgment per their own policies.

8. Intellectual Property

8.1 Our Content

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of Nercha or our licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Your Content

By submitting content (including prayers, messages, or feedback) to our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with providing our Services.

TO THE FULLEST EXTENT PERMITTED BY LAW, NERCHA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• OUR SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS
• OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THE RESULTS OBTAINED FROM USING OUR SERVICES WILL BE ACCURATE OR RELIABLE
• ANY ERRORS IN OUR SERVICES WILL BE CORRECTED

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NERCHA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE OUR SERVICES
2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OUR SERVICES
3. ANY CONTENT OBTAINED FROM OUR SERVICES
4. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL NERCHA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO NERCHA OVER THE PAST SIX MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use our Services will immediately cease. If you wish to terminate your account, you may simply discontinue using our Services or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation, ownership provisions, warranty disclaimers, limitation of liability, and indemnification.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Kerala, India.

We make no representation that our Services are appropriate or available for use in other locations. Those who access or use our Services from other jurisdictions do so at their own volition and are responsible for compliance with local law.
